href=\"https:\/\/glutenfreepleasure.com\/__proxy_domain\/help.law.com.sg\/faq\/what-is-the-meaning-of-domicile-of-a-deceased-person\/\" target=\"_blank\" rel=\"noreferrer noopener\">domiciled outside Singapore<\/a> are governed by Part 6, rule 22 of the Family Justice (Probate and Other Matters) Rules 2024, subject to the applicable saving and transitional provisions for older proceedings.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-grants-apply-where-the-deceased-died-domiciled-outside-singapore\">What grants apply where the deceased died domiciled outside Singapore?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When a person dies domiciled outside Singapore but leaves assets in Singapore, special rules apply.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From 15 October 2024, these situations are governed by <strong><a href=\"https:\/\/sso.agc.gov.sg\/SL\/FJA2014-S723-2024\/?ProvIds=P16-#pr22-\" target=\"_blank\" rel=\"noreferrer noopener\">Part 6, rule 22<\/a> of the Family Justice (Probate and Other Matters) Rules 2024<\/strong> (\u201c<strong>FJ (Probate) Rules 2024<\/strong>\u201d).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This provision replaces former <strong><a href=\"https:\/\/sso.agc.gov.sg\/SL-Supp\/S813-2014\/Published\/20141215?DocDate=20141215&amp;ProvIds=P114-#pr227-\" target=\"_blank\" rel=\"noreferrer noopener\">rule 227<\/a> of the Family Justice Rules 2014<\/strong>, which applied to foreign-domiciled deceased estates before the new rules took effect.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Note:<\/strong> Because of saving and transitional provisions, the old 2014 Rules may still apply to some older cases filed before 15 October 2024.<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-which-singapore-rule-now-covers-foreign-domiciled-deceased\">Which Singapore rule now covers foreign-domiciled deceased?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The relevant rule is:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Part 6, rule 22 \u2013 \u201cGrants where deceased died domiciled outside Singapore\u201d<\/strong> in the FJ (Probate) Rules 2024.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Rule 22 applies where:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <strong>deceased died domiciled outside Singapore<\/strong>; and<\/li>\n\n\n\n<li>You seek a <strong>grant of probate or letters of administration in Singapore<\/strong> in respect of assets here.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-who-may-apply-for-a-grant-under-rule-22-1\">Who may apply for a grant under rule 22(1)?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Where the deceased died domiciled outside Singapore, <strong>an application to the Registrar for an order for a grant<\/strong> may be made in favour of the following persons: <a href=\"https:\/\/sso.agc.gov.sg\/SL\/FJA2014-S723-2024\/?ProvIds=P16-\" target=\"_blank\" rel=\"noreferrer noopener\">Singapore Statutes Online<\/a><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Person appointed by foreign probate court or authority<\/strong>\n<ul class=\"wp-block-list\">\n<li>The person entrusted with the administration of the estate by the <strong>court or authority having jurisdiction in matters of probate<\/strong> in the country of domicile.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Person entitled under the law of the place of domicile<\/strong>\n<ul class=\"wp-block-list\">\n<li>The person who is <strong>entitled to administer the estate by the law of the place where the deceased was domiciled<\/strong>.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Person directed by the Registrar (discretionary)<\/strong>\n<ul class=\"wp-block-list\">\n<li>If such a person does not exist,<\/li>\n\n\n\n<li>Or if, in the Registrar\u2019s opinion, the <strong>circumstances justify a different arrangement<\/strong>,<\/li>\n\n\n\n<li>The Registrar may direct that the grant be made to <strong>another suitable person<\/strong>.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Where at least 2 administrators are required (section 6 Probate and Administration Act)<\/strong>\n<ul class=\"wp-block-list\">\n<li>In some cases, <strong>at least 2 administrators<\/strong> must be appointed, for example where there is a minor or a life interest.<\/li>\n\n\n\n<li>In such situations, the Registrar may direct that the grant be made <strong>jointly<\/strong>:\n<ul class=\"wp-block-list\">\n<li>to a person mentioned in (1) or (2) above <strong>together with<\/strong> another person; or<\/li>\n\n\n\n<li>to such other persons as the Registrar may direct.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">In short, the rule respects <strong>foreign appointments and foreign law<\/strong>, but the <strong>Registrar retains discretion<\/strong> to ensure proper administration in Singapore.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-happens-if-there-is-no-application-under-rule-22-1\">What happens if there is no application under rule 22(1)?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Sometimes, no foreign-appointed administrator or other eligible person applies under rule 22(1).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In that case, <strong>rule 22(2) allows alternative routes<\/strong>, despite paragraph (1): <\/p>\n\n\n\n<h4 class=\"wp-block-heading\">(a) Probate of a will that is admissible to proof<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">If the deceased left a will that is <strong>admissible to proof<\/strong> in Singapore:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>If the will is in English<\/strong>\n<ul class=\"wp-block-list\">\n<li>Probate may be granted to the <strong>executor named in the will<\/strong>.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Executor \u201caccording to the tenor\u201d<\/strong>\n<ul class=\"wp-block-list\">\n<li>Even if the person is not expressly called \u201cexecutor\u201d,<\/li>\n\n\n\n<li>Probate may still be granted to a <strong>named person whose duties in the will are described clearly enough<\/strong> to make that person an executor \u201caccording to the tenor\u201d of the will.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This provides a route for a <strong>named executor (or equivalent)<\/strong> to obtain probate in Singapore, even if no one has first obtained a foreign grant.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-if-the-singapore-estate-only-consists-of-immovable-property\">What if the Singapore estate only consists of immovable property?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Rule 22(2)(b) deals with cases where <strong>all the deceased\u2019s assets in Singapore are immovable property<\/strong> (for example, a condominium or landed property):<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The court may grant a <strong>limited grant<\/strong> restricted to the <strong>immovable property in Singapore<\/strong> only.<\/li>\n\n\n\n<li>This limited grant is made <strong>in accordance with the law that would have applied if the deceased had died domiciled in Singapore<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This allows the Singapore court to <strong>deal efficiently with local real property<\/strong>, without needing to administer a wider foreign estate.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-does-this-differ-from-the-old-rule-227-fjr-2014\">How does this differ from the old rule 227 FJR 2014?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong>substance<\/strong> of the law is broadly similar, but there are important updates:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The current rule refers to the <strong>\u201ccourt or authority having jurisdiction in matters of probate\u201d<\/strong> at the place of domicile, which clarifies the type of foreign body recognised. <\/li>\n\n\n\n<li>Drafting has been modernised to use <strong>gender-inclusive language<\/strong> (\u201chim or her\u201d, \u201chis or her discretion\u201d).<\/li>\n\n\n\n<li>The rule now sits within the new <strong>Family Justice (Probate and Other Matters) Rules 2024 framework<\/strong>, which replaced the Family Justice Rules 2014 from 15 October 2024. <\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">For <strong>older proceedings filed before 15 October 2024<\/strong>, rule 227 FJR 2014 may still apply because of the transitional provisions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-practical-points-for-foreign-domiciled-estates-with-singapore-assets\">Practical points for foreign-domiciled estates with Singapore assets<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In practice, you should expect:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Evidence of foreign domicile<\/strong>\n<ul class=\"wp-block-list\">\n<li>The court may require evidence of the deceased\u2019s <strong>domicile at the time of death<\/strong>, such as foreign identity documents, residence records, or expert evidence of foreign law.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Evidence of foreign appointment or entitlement<\/strong>\n<ul class=\"wp-block-list\">\n<li>If you rely on paragraph (1)(a) or (b), you usually need to show:\n<ul class=\"wp-block-list\">\n<li>the <strong>foreign grant or order<\/strong>, or<\/li>\n\n\n\n<li>relevant <strong>foreign law provisions<\/strong> establishing your right to administer.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Registrar\u2019s discretion<\/strong>\n<ul class=\"wp-block-list\">\n<li>The Registrar may still direct that the grant be made to <strong>another person or persons<\/strong>, especially where:\n<ul class=\"wp-block-list\">\n<li>minors or life interests are involved (section 6 of the Probate and Administration Act); <\/li>\n\n\n\n<li>there is a dispute between family members; or<\/li>\n\n\n\n<li>there are concerns about proper administration.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Because foreign-domiciled estates often involve <strong>conflicts of law<\/strong> and <strong>procedural nuances<\/strong>, professional advice is usually advisable.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-should-i-consult-a-singapore-probate-lawyer\">Should I consult a Singapore probate lawyer?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Yes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rule 22 interacts with:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the <strong>Probate and Administration Act 1934<\/strong>;<\/li>\n\n\n\n<li>the broader <strong>Family Justice (Probate and Other Matters) Rules 2024<\/strong> structure; and <\/li>\n\n\n\n<li>any <strong>foreign law or foreign court orders<\/strong> relating to the estate.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A Singapore probate lawyer can:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Review the <strong>deceased\u2019s domicile and connections<\/strong>.<\/li>\n\n\n\n<li>Identify <strong>who is best placed to apply<\/strong> under rule 22.<\/li>\n\n\n\n<li>Advise whether a <strong>limited grant over immovable property<\/strong> is appropriate.<\/li>\n\n\n\n<li>Draft the necessary court documents in line with the latest rules and
