All co-administrators must agree and jointly make the application.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-must-be-included-in-the-application\">What must be included in the application?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You must submit a <strong>summons<\/strong> and an <strong>affidavit<\/strong> that clearly states:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Date of the deceased&#8217;s death.<\/li>\n\n\n\n<li>Efforts made to find sureties, or reasons why sureties cannot be found.<\/li>\n\n\n\n<li>For deaths <strong>before 15 February 2008<\/strong>, confirmation on estate duty (whether paid, exempt, postponed, or cleared).<\/li>\n\n\n\n<li>List of beneficiaries, their shares in the estate, their ages, and whether all adult beneficiaries consent.<\/li>\n\n\n\n<li>Details of any <strong>vulnerable beneficiaries<\/strong> (infants or those lacking mental capacity):\n<ul class=\"wp-block-list\">\n<li>Names, relationships to administrators.<\/li>\n\n\n\n<li>Any relevant Court orders under the <em>Guardianship of Infants Act<\/em> or <em>Mental Capacity Act<\/em>.<\/li>\n\n\n\n<li>Steps to protect their interests, such as how their inheritance will be managed.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Whether the estate has <strong>unsecured creditors<\/strong>, the amount owed, and whether these creditors consent.<\/li>\n\n\n\n<li>Any other relevant information.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-supporting-documents\">Supporting documents<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Written <strong>consent from all adult beneficiaries<\/strong>. These must be signed in front of a solicitor or Commissioner for Oaths.<\/li>\n\n\n\n<li>If estate duty applies (for older estates), a letter from the Commissioner of Estate Duties.<\/li>\n\n\n\n<li>If no estate duty applies (pre-2008 deaths), a statement confirming this and that the Schedule of Property has been submitted to Court.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-happens-if-a-creditor-does-not-consent\">What happens if a creditor does not consent?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You must serve them with your application and supporting affidavit and inform them of the hearing date.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-must-vulnerable-beneficiaries-be-protected\">How must vulnerable beneficiaries be protected?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Steps must comply with the law and depend on the situation.
