(2026).

Are dividends from a Dubai subsidiary exempt under section 13(8)?

Not on IRAS’s published rule. Section 13(8) of the Income Tax Act exempts foreign dividends received in Singapore only if three tests are met (IRAS e-Tax Guide on foreign-sourced income, 5th edition, paras 2.1 and 8.1 to 8.4): the income was subject to tax abroad; the source country’s headline tax rate, meaning its highest corporate rate in the year of receipt, is at least 15%; and the exemption benefits the Singapore company. With the UAE’s top rate at 9%, a Dubai dividend fails the middle test, even where the Dubai company actually paid 9%.

IRAS publishes the rule, not a list of countries. We found no IRAS publication that names the UAE, so this is VIVOS’s application of the published rule to UAE law, checked on 6 October 2026.

Does the UAE’s 15% top-up tax count toward the headline rate?

No, and it only arises for large groups: the UAE’s Domestic Minimum Top-up Tax (DMTT) applies only to groups with revenue of EUR 750 million or more (UAE Ministry of Finance). For groups that do pay it, IRAS treats it two ways in its e-Tax Guide on section 13(12) (12th edition, 7 January 2026): it counts as tax paid (para 8.1), but it is left out when the headline rate is worked out (para 8.2).

How is a Singapore company with a Dubai subsidiary taxed on dividends?

At 17% on dividends received in Singapore, with relief through the treaty or a unilateral credit (IRAS e-Tax Guide, paras 4.2, 5.3 and 7.1). Under Article 23(3) of the Singapore-UAE double tax agreement (DTA), the credit takes into account UAE tax on the profits out of which the dividend is paid; the dividend itself bears no UAE withholding.

So the credit follows the Dubai company’s tax bill. On AED 1,000,000 of taxable income, a Dubai company pays AED 56,250 (0% on the first AED 375,000, 9% on the rest), an effective 5.6%: that covers part of the Singapore tax, not all of it. A qualifying free zone person paying 0% leaves little or nothing to credit, so a remitted dividend could bear close to the full 17%.

What if the dividend stays outside Singapore?

Then Singapore does not tax it yet: foreign dividends are taxed when received in Singapore. Check what counts as receipt before moving or using the money, and keep the Dubai company’s dividend records and tax returns for any credit claim.

Can a section 13(12) application help?

Possibly, if it is made in time. Section 13(12) is the Ministry of Finance’s power to exempt foreign income that falls outside section 13(8). The application must reach MOF before the income is received in Singapore, and MOF weighs each case on whether the remittance brings economic benefits to Singapore (IRAS section 13(12) e-Tax Guide, paras 7 and 9.2). Do not count on the guide’s “specified scenarios”: they deem the 15% condition met only where a treaty contains a clause to that effect, and no such clause exists in the Singapore-UAE treaty.

What does the Singapore company deduct when it pays the Dubai company?

Singapore tax at source on payments to a Dubai company under the Singapore-UAE treaty, as of October 2026 (checked 6 October 2026)

Payment (SG → UAE)

Singapore tax at source

Treaty article

Watch for

Interest on an intercompany loan

0%: taxable only in the UAE

Art 11(1), as replaced by the Second Protocol

Not for interest connected with a permanent establishment of the Dubai company in Singapore (Art 11(3))

Royalties (IP, software, brand licences)

Capped at 5% of the gross amount

Art 12(2)

The Dubai company must be the beneficial owner; not for royalties connected with a permanent establishment in Singapore (Art 12(5))

Sources: IRAS treaty text (Second Protocol effective from 1 January 2017). Both rates need the Dubai company to be a UAE resident under UAE tax law (Art 4(1)), and Article 27A, added through the Multilateral Instrument, can deny treaty benefits where obtaining them was one of the principal purposes of an arrangement. Section 13(8) needs the income to have been taxed abroad, a headline tax rate of at least 15% in the source country, and a benefit to the Singapore company. The UAE’s highest corporate rate is 9%, so Dubai dividends fail the second condition. IRAS publishes the rule, not a country list, so this is VIVOS’s reading of it.

How much credit does Singapore give for UAE tax on a Dubai dividend?

Under Article 23(3) of the Singapore-UAE treaty, the credit takes into account UAE tax on the profits of the company paying the dividend. A Dubai company with AED 1,000,000 of taxable income pays AED 56,250, an effective 5.6%, which covers part of Singapore’s 17%. Where the Dubai company paid little or no UAE tax, the dividend could bear close to the full 17%.

Can a Singapore company apply to MOF to exempt Dubai dividends?

Yes, under section 13(12), but only before the dividend is received in Singapore. MOF decides case by case, looking at whether the remittance brings economic benefits to Singapore (IRAS section 13(12) e-Tax Guide, paras 7 and 9.2). The guide’s specified scenarios do not cover Dubai dividends, because the Singapore-UAE treaty has no clause deeming the 15% condition met.

Is a Dubai dividend taxed in Singapore if it stays offshore?

No. Singapore taxes foreign-sourced dividends when they are received in Singapore, so a dividend kept outside Singapore is not taxed there yet. Once received, it is taxable at 17% unless exempt, and section 13(8) does not exempt Dubai dividends because the UAE’s 9% headline rate is below 15%.
