divorce<\/strong><\/a>.<\/p>\n<p>The following paragraphs serve as a rough guide to the initial stages of commencing divorce proceedings.<\/p>\n<p>Before commencing <a title=\"divorce procedures\" href=\"https:\/\/glutenfreepleasure.com\/__proxy_domain\/www.singaporedivorcelawyer.com.sg\/divorce-proceedings\/\"><strong>divorce procedures<\/strong><\/a> it is necessary to send out Standard Queries Forms to the Housing Development Board (HDB) and the Central Provident Fund (CPF) Board (reply will take around a month)<\/p>\n<h2 class=\"blogpost\">Documents to be Filed<\/h2>\n<p>Divorce proceedings will commence with the filing of relevant documents including the following:<\/p>\n<ul class=\"blogpost\">\n<li><strong>Writ for Divorce<\/strong>: means to commence divorce suit<\/li>\n<li><strong>Statement of Claim<\/strong>: state which fact (<a href=\"https:\/\/glutenfreepleasure.com\/__proxy_domain\/www.singaporedivorcelawyer.com.sg\/adultery-faqs\/\" target=\"_blank\" rel=\"noopener noreferrer\">adultery<\/a>, <a href=\"https:\/\/glutenfreepleasure.com\/__proxy_domain\/www.singaporedivorcelawyer.com.sg\/divorce-singapore-unreasonable-behaviour\/\" target=\"_blank\" rel=\"noopener noreferrer\">unreasonable behaviour<\/a>, <a href=\"https:\/\/glutenfreepleasure.com\/__proxy_domain\/www.singaporedivorcelawyer.com.sg\/desertion-for-2-years\/\" target=\"_blank\" rel=\"noopener noreferrer\">desertion for at least 2 years<\/a>, <a href=\"https:\/\/glutenfreepleasure.com\/__proxy_domain\/www.singaporedivorcelawyer.com.sg\/methods-separation-pursuing-divorce-singapore\/\" target=\"_blank\" rel=\"noopener noreferrer\">three years\u2019 separation<\/a> with consent or four years\u2019 separation and mutual agreement) you are relying on to ask the Court to grant you divorce<\/li>\n<li><strong>Statement of Particulars<\/strong>: state details of the fact you are relying on<\/li>\n<li><strong>Form 271<\/strong>: for divorce by mutual agreement<\/li>\n<li><strong>Proposed\/Agreed Parenting Plan<\/strong>: (if you have children below 21) regarding custody, care and control of children.<\/li>\n<li><strong>Proposed\/Agreed Matrimonial Property Plan<\/strong>: (if there is an HDB flat as matrimonial property) payment of outstanding loans, division based on contributions to purchase price<\/li>\n<li><strong>Acknowledgement of Service<\/strong>: signed by Defendant<\/li>\n<li><strong>Memorandum of Appearance<\/strong>: Defendant to indicate if he\/she intends to contest the divorce and\/or contest ancillary matters<\/li>\n<\/ul>\n<h2 class=\"blogpost\">Service of documents<\/h2>\n<p>As a requirement under the Family Justice Rules, the sealed copies of your documents must be served on the Defendant to alert him\/her of the <a href=\"https:\/\/glutenfreepleasure.com\/__proxy_domain\/www.gjclaw.com.sg\/areas-of-practice\/family-law\/the-divorce-process\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>divorce proceedings in Singapore<\/strong><\/a>. <\/p>\n<p>There are various ways for this to be done:<\/p>\n<ul class=\"blogpost\">\n<li><strong>Personal Service<\/strong> \u2014 documents handed directly to Defendant by a court process server<\/li>\n<li><strong>Registered Post<\/strong> \u2014 documents posted to Defendant\u2019s address (only accepted if Defendant signs and returns Acknowledgement of Service)<\/li>\n<li><strong>E-Litigation<\/strong> on the Defendant\u2019s lawyer<\/li>\n<\/ul>\n<p>If service of papers on the Defendant fails after 2 attempts of service, or if the Defendant\u2019s address is unknown but you believe he\/she is still residing in Singapore, you may take out an application in the Family Court for Substituted Service.<\/p>\n<p>In the event that the Defendant chooses to ignore the <a href=\"https:\/\/glutenfreepleasure.com\/__proxy_domain\/www.singaporedivorcelawyer.com.sg\/serving-divorce-papers-singapore\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>divorce papers<\/strong><\/a>, a Request for Setting Down Action for Trial can be filed for and the court may fix a hearing date where the divorce may be granted in the absence of the Defendant.<\/p>\n<p><a href=\"https:\/\/glutenfreepleasure.com\/__proxy_domain\/www.singaporedivorcelawyer.com.sg\/can-you-divorce\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Filing for divorce<\/strong><\/a> can be done independently without engaging a lawyer (\u201cacting in person\u201d) but you will not be exempt from the legal, procedural and formal requirements of
