{"id":38420,"date":"2019-08-30T15:15:37","date_gmt":"2019-08-30T15:15:37","guid":{"rendered":"https:\/\/glutenfreepleasure.com\/__proxy_domain\/www.singaporedivorcelawyer.com.sg\/?p=5229"},"modified":"2025-06-21T13:40:33","modified_gmt":"2025-06-21T05:40:33","slug":"proving-spouses-intention-desert","status":"publish","type":"post","link":"https:\/\/glutenfreepleasure.com\/__proxy_domain\/www.singaporedivorcelawyer.com.sg\/proving-spouses-intention-desert\/","title":{"rendered":"Proving your Spouse\u2019s Intention to Desert you"},"content":{"rendered":"<p class=\"jumper-bigtext\">Desertion is one of the <a href=\"https:\/\/glutenfreepleasure.com\/__proxy_domain\/www.singaporedivorcelawyer.com.sg\/grounds-for-divorce-singapore\/\"><strong>four grounds<\/strong><\/a> couples can rely on when filing for a divorce in Singapore.<\/p>\n<p>Desertion refers to the event where one spouse deserts the other in a way that establishes his\/her rejection of their existing marital relationship. <\/p>\n<p><strong><em>In order to prove desertion, two factors must be established:<\/em><\/strong><\/p>\n<ul class=\"blogpost\">\n<li>The couple has been <a href=\"https:\/\/glutenfreepleasure.com\/__proxy_domain\/www.singaporedivorcelawyer.com.sg\/desertion-for-2-years\/\">physically separated for a continuous period of two years<\/a>.<\/li>\n<li>The spouse who has deserted had the intention to do so.<\/li>\n<\/ul>\n<p>On the grounds of desertion, the party\u2019s <em>intention to desert<\/em> amounts to the act of bringing the marriage to a permanent end. <\/p>\n<p><strong><em>To show that there was an intention to desert, the spouse filing for divorce must prove that:<\/em><\/strong><\/p>\n<ul class=\"blogpost\">\n<li>It was non-consensual.<\/li>\n<li>There was no good cause for leaving.<\/li>\n<\/ul>\n<h2 class=\"blogpost\">Not consensual<\/h2>\n<p>To show that a spouse\u2019s intention to desert the other was non-consensual, the other party must prove in court that he\/she was abandoned by the other against his\/her wishes. <\/p>\n<p>This means that both spouses must not have agreed to live separately. As such, if the couple agreed to live in separate households, either party cannot <strong><a href=\"https:\/\/glutenfreepleasure.com\/__proxy_domain\/www.singaporedivorcelawyer.com.sg\/can-you-divorce\/\">file for a divorce<\/a><\/strong> on the basis of desertion. <\/p>\n<p>However, if one party chooses to cohabitate again after mutually agreeing to live apart but the other party refuses, this can reflect an intention to desert.<\/p>\n<p>In the event where more than two years have passed and the spouse who did not consent to live apart eventually accepts the departure of the other spouse, there may be a <strong><a href=\"https:\/\/glutenfreepleasure.com\/__proxy_domain\/www.singaporedivorcelawyer.com.sg\/desertion-for-2-years\/\" rel=\"noopener\" target=\"_blank\">case for desertion<\/a><\/strong> in the eyes of the law.<\/p>\n<h2 class=\"blogpost\">No good cause<\/h2>\n<p>It is also important to show that the spouse who deserted had intentions to do and did not act as a result of his\/her circumstances. <\/p>\n<p>For example, if the couple had been physically separated because, for instance, one of them had to travel overseas for a long-term work commitment or had been hospitalised for a long period of time, the court will not record any intention to desert. <\/p>\n<p>This is because it was required for the couple to live apart based on the circumstances. This does not lead to a breakdown of a common household which desertion implies.<\/p>\n<p>Desertion cannot be used as grounds for divorce in the case where one party had left due to the behaviour of the other, as this would constitute as a \u2018good cause\u2019 for the spouse to leave.
