civil litigation lawyer in Singapore

Introduction:

In Singapore, civil litigation encompasses a broad spectrum of legal disputes where one party is accused of non-criminal wrongdoing. Resolving these disputes involves compensation or injunctive measures. Whether it is a minor dispute or a complex civil suit, Understanding the civil litigation process and the advantages of hiring a specialist civil litigation lawyer is essential for favorable outcomes.

Issuing a Letter of Demand:

Before commencing formal legal proceedings, it is advisable to issue a letter of demand to the opposing party. This letter serves several purposes, including clearly stating the plaintiff’s demands, outlining the legal grounds for the claim, setting a compliance deadline, and notifying the potential initiation of legal action if non-compliance occurs. A well-drafted letter of demand can often lead to the resolution of disputes without resorting to costly and time-consuming litigation. It provides an opportunity for parties to engage in negotiations and reach a mutually agreeable settlement.

Here are the steps involved in issuing a letter of demand in Singapore:

Understand the Rights and Grounds: Gain a comprehensive understanding of the rights and legal grounds supporting the claim. Consult with a qualified civil litigation lawyer to ensure accuracy and strength in formulating the letter of demand.

Clearly Articulate the Demands: Clearly state the specific demands being made, such as compensation for damages, return of property, or cessation of certain actions. Support each demand with relevant facts and legal arguments.

Specify a Compliance Deadline: Include a reasonable compliance deadline to encourage timely resolution. Allow the opposing party sufficient time to respond and take appropriate action, while emphasizing the importance of prompt compliance.

Indicate Consequences of Non-Compliance: Clearly communicate the potential consequences of non-compliance, including the initiation of legal proceedings to protect rights and seek remedies.

Seek Professional Legal Assistance: Engage an experienced civil litigation lawyer, such as a member of our IRB Law team, to ensure a well-crafted letter that meets legal requirements and maximizes the chances of a favorable response.

Deliver the Letter of Demand: Use a registered postal service or engage a process server to deliver the letter, retaining proof of delivery.

Evaluate the Response: Assess the opposing party’s response within the specified deadline. They may comply, negotiate a settlement, or dispute the claims, determining the next steps in the litigation process.

Commencing a Civil Suit:

If the letter of demand is ignored or met with noncompliance, initiating a civil suit becomes necessary. This involves filing a writ of summons and a statement of claim with the appropriate court and serving these documents on the defendant. The choice of the court depends on the monetary value of the claim.

Understanding the jurisdictional thresholds is crucial:

Small Claims Tribunal: Claims under S$20,000 can be brought before the Small Claims Tribunal. This tribunal offers a simplified and expedited process, making it ideal for resolving smaller disputes in an efficient and cost-effective manner.

Magistrates’ Court: Claims between S$20,000 and S$60,000 fall within the jurisdiction of the Magistrates’ Court. This court handles a wide range of civil cases and employs streamlined procedures to ensure timely resolution.

District Court: Claims between S$60,000 and S$250,000 are heard in the District Court. This court has broader jurisdiction and deals with more complex cases that require greater attention to detail and legal expertise.

High Court: Claims exceeding S$250,000 fall under the purview of the High Court. The High Court handles high-value and complex disputes, offering a forum for cases that require meticulous preparation, sophisticated legal arguments, and extensive evidence.

Examples of Areas for Civil Litigation:

Civil litigation becomes necessary in various scenarios where individuals or entities seek legal remedies for non-criminal wrongs. Here are some examples of situations that often lead to civil litigation:

Personal Injury: When someone suffers harm or injury due to the negligence or intentional actions of another party, they may file a civil lawsuit seeking compensation for medical expenses, pain and suffering, and other damages.

Contract Disputes: When disputes arise over the terms, performance, or breach of a contract, parties may initiate civil litigation to enforce the contract, seek damages for losses incurred, or request specific performance of contractual obligations.

Property Disputes: Disagreements over real estate, such as boundary disputes, ownership claims, or breach of property agreements, can lead to civil litigation to establish legal rights, resolve conflicts, and seek appropriate remedies.

Employment Disputes: Issues related to employment contracts, wrongful termination, workplace discrimination, or harassment may necessitate civil litigation to protect employee rights, seek compensation, or enforce legal obligations.

Intellectual Property Infringement: When intellectual property rights, such as patents, copyrights, or trademarks, are infringed upon, civil litigation can be initiated to stop the infringement and seek damages or injunctive relief.

Professional Malpractice: If professionals, such as doctors, lawyers, accountants, or architects, provide services below the acceptable standard of care, resulting in harm or financial loss, civil litigation may be pursued to hold them accountable and seek compensation.

Defamation: False statements that harm a person’s reputation can lead to defamation claims and subsequent civil litigation, aiming to obtain damages for reputational harm and seek injunctions to stop further dissemination.

Product Liability: When injuries or damages occur due to defective or unsafe products, individuals may file civil lawsuits against manufacturers, distributors, or sellers to seek compensation for injuries, medical expenses, and other losses.

These are just a few examples illustrating the broad range of situations that necessitate civil litigation. In each case, seeking legal advice from a qualified civil litigation lawyer is crucial to assess the merits of the claim and determine the appropriate legal recourse.

Alternatives to Civil Litigation in Singapore:

While civil litigation is a common method for resolving disputes in Singapore, alternative approaches may provide a more efficient and cost-effective resolution.

Here are some notable methods of alternative dispute resolution available in Singapore:

Mediation: Mediation is a voluntary and confidential process in which a neutral third party— the mediator— facilitates communication and negotiation between the disputing parties. The mediator assists in identifying common interests, exploring options, and reaching a mutually acceptable agreement. Mediation offers flexibility, allows for creative solutions, and promotes a cooperative approach to dispute resolution. It can be particularly useful in preserving relationships and maintaining confidentiality.

Arbitration: Arbitration is a private and consensual process in which parties submit their dispute to one or more arbitrators who make a binding decision, known as an award. Unlike mediation, arbitration provides a decision that is enforceable by law. It offers flexibility in terms of selecting arbitrators with expertise in the specific subject matter of the dispute. Arbitration is often preferred for complex disputes involving technical or commercial issues.

Negotiation: Negotiation involves direct discussions between the parties with the aim of reaching a mutually acceptable resolution. It gives parties control over the outcome and can be conducted informally or with the assistance of legal representatives. Negotiation provides a flexible and collaborative approach to resolving disputes, and it is often the preferred method when parties seek to preserve relationships and maintain confidentiality.

Collaborative Law: Collaborative law is a voluntary process where both parties and their respective lawyers commit to resolving the dispute without resorting to litigation. The process involves face-to-face meetings and open communication to explore interests, identify common goals, and work towards a mutually beneficial outcome. Collaborative law focuses on problem-solving rather than adversarial positions and encourages a cooperative approach.

Dispute Resolution through Government Agencies: In Singapore, various government agencies offer alternative dispute resolution services for specific types of disputes. For example, the Singapore Mediation Centre (SMC) provides mediation services for commercial, civil, and family-related disputes. The Community Mediation Centre (CMC) specializes in mediating community disputes, while the Employment Claims Tribunal (ECT) offers a streamlined process for resolving employment-related disputes.

Choosing the appropriate alternative dispute resolution method depends on the nature of the dispute, the desired outcome, and the parties’ willingness to engage in the process. It is advisable to seek legal advice to assess the suitability of these alternatives and determine the best approach for your specific circumstances.

Seeking Legal Advice:

Deciding to pursue a lawsuit entails careful consideration and evaluation of various factors. Seeking legal advice from experienced litigation lawyers is essential in making informed decisions. These professionals can assess the strengths and weaknesses of your claim, provide strategic options for a successful outcome, estimate the potential costs involved, and evaluate the defendant’s assets to determine their ability to satisfy the claim. By obtaining comprehensive legal advice, you can better understand the merits of your case and make informed decisions regarding the best course of action.

We engaged IRB for a recent case and had an absolutely wonderful experience with Mr Baiross and Mr Joel. From our very first consultation, we knew we were in good hands. Mr Baiross took the time to understand our situation and walked us through the potential consequences with so much empathy, patience and genuine concern. He never made us feel rushed, and his ability to explain everything clearly gave us a lot of reassurance during what was a very stressful period for us. It was clear from the very first conversation that he genuinely cared about helping us, and we knew we wanted to engage him and his team. We were also incredibly fortunate to work with Joel throughout the process. His friendly and approachable demeanour made it so easy to communicate with him. He always kept us focused on the end goal, while making the entire process feel much less daunting. At times, it genuinely felt like we were discussing things with a friend rather than a lawyer. What we appreciated most about Joel was his ability to empathise with our situation and understand how we were feeling before offering his thoughts and advice. He never made us feel like our concerns were insignificant, and we always felt heard, respected and supported. His professionalism, patience and personal touch really stood out to us. Highly recommended to anyone looking for a team that is not only professional and knowledgeable, but also genuinely empathetic and invested in their clients.

I engaged Mr Dzuleqhmal and his team from IRB Law for my divorce recently. They were very professional. The team is big and they all did their parts. Some of the team members who liaised with me directly were Mr Fadil, Mr Patrick, Ms Hafizah and Ms Sharmeela. Mr Fadil was available in between appointments whenever I needed to clear any doubts (and I had many!). Thank you for being very patient with me. Ms Sharmeela was with me twice during mediation at the Syariah Court. She was very supportive and explained points and outcomes clearly. She was calm and maintained her composure extremely well when my ex-spouse raised his voice at her and the mediator. Thank you for supporting me during some of my most vulnerable moments. I truly appreciate it. The divorce eventually closed without going on to PTC and a hearing, and the outcome was also in favour of me and my boys. I can’t recommend Mr Dzuleqhmal and his team enough.

We would like to extend our sincere gratitude to the team at I.R.B Law LLP, especially Rano, who attended the court hearing with us, as well as everyone who assisted us throughout the entire divorce proceedings. This journey was definitely not an easy one, and there were many uncertainties along the way. We are thankful that throughout the entire process, the team was always patient in listening to our concerns and guiding us whenever we were unsure of the next step. They made the legal process easier for us to understand and gave us the reassurance we needed to get through each stage. One thing we especially appreciated was how realistic and transparent the team was with us. They would always prepare us for what to expect, including the possible worst-case scenarios. Rather than giving us false expectations, they helped us understand the different possibilities and manage our expectations accordingly. This allowed us to mentally prepare ourselves for whatever the outcome might be, even if it was not necessarily the outcome we hoped for. That honesty and guidance meant a lot to us throughout the process. Whenever we had questions or were unsure about something, the team was always there to guide us through it. Our enquiries were attended to promptly and professionally, and we truly appreciated how responsive and patient they were, especially during moments when we needed further clarification or reassurance. What meant the most was knowing that we did not have to navigate such a difficult process alone. Having a team that was professional yet understanding made an already stressful and emotionally exhausting journey much more manageable. Now that this chapter has finally come to an end, one thought feels especially fitting: “Today is not about who won or who lost. It is about finally closing a chapter that took more from everyone than it should have. Some endings don’t need celebration or resentment — just acceptance, peace, and the grace to move forward.” And that is exactly how we choose to look at the end of this journey. To Rano and the entire I.R.B team who played a part in getting us through this process, thank you for your professionalism, honesty, patience, guidance and support. We are sincerely grateful for everything you have done for us, and it will not be forgotten. 🤍

I did my HDB POA with IRB July-Aug 2026. As I am overseas, they helped with all additional procedures like local notary sign, instant verification, courier and final collection. Madam Lina was so prompt that she was answering even at 11pm SGT. Whole team did good job. Keep it up!

We had an excellent experience with IRB Law for a probate matter in Singapore, much of which we handled from overseas. Andrew Wong and Haikel Shah at Mountbatten Square were professional, responsive and helpful throughout. They always replied promptly, explained everything clearly and were very accommodating when we had tight deadlines, fitting us into their busy schedules when needed. Their support made a difficult process much easier for our family. We would not hesitate to recommend them to others.

I would like to express my profound, heartfelt gratitude to Mr. Dzuleqhmal, Mr. Fadil, Mr. Aidil and Ms. Sharmeela. After a long, exhausting and challenging 3 years (since 2023) legal battle in the Syariah Court, justice has finally been served for me and my children. Throughout this painful journey, we faced countless obstacles including persistent delays and failure from the opposing party to submit necessary forms. Yet, my lead lawyer, Mr. Dzul, and his remarkable team remained an unshakeable pillar of strength, backing me with unwavering and wholehearted support. Mr. Dzul and Mr. Fadil were by my side every single step of the way. Their meticulous dedication and tireless effort in navigating complex paperwork particularly in crafting and managing my massive, 800 pages AEIC were nothing short of extraordinary. I vividly remember our very first meeting in 2024 when I broke down and told Mr. Dzul I just wanted everything to end quickly. During the toughest moments of the fight in Family Court, his profound, comforting words anchored me: "It is not about ending fast, but ending right. I want to bring justice to you." He truly honored those words, fighting fiercely, compassionately and relentlessly alongside me until the very end. Thanks to their incredible dedication, brilliant legal strategy and constant encouragement, this arduous battle ended not in defeat but with overwhelming tears of joy and complete relief!!! I whole-heartedly and unreservedly recommend Mr. Dzul and his exceptional team to anyone seeking a reliable, compassionate and fiercely dedicated Syariah lawyer. Thank you for giving us our lives back, for standing in our corner when we needed it most and for your unmatched excellence. Thank you for everything, we won it all! Alhamdullilah Ya Allah!

We consulted several lawyers before deciding who to engage for our case, and choosing Mr Dzuleqhmal was one of the best decisions we made. From our very first consultation, Mr Dzuleqhmal was patient, attentive, and took the time to understand our concerns. Our case was particularly challenging as it involved a variation of a court order relating to child access, where access had been denied despite an existing court order being in place. Throughout the process, Mr Dzuleqhmal and his team were professional, efficient, and consistently responsive. He clearly explained every stage of the matter, including the expected timeline, court procedures, hearings, and child evaluation processes, which helped us feel informed and prepared. What stood out most was his attention to detail, thorough preparation, and strong advocacy in court. He was precise in his work, strategic in his approach, and articulated our position effectively during proceedings. His knowledge of family law and commitment to achieving the best outcome for his client gave us confidence throughout the case. I would highly recommend Mr Dzuleqhmal and his team to anyone seeking legal representation in family law matters, especially complex child access and custody-related cases. Thank you for your professionalism, dedication, and support throughout this journey.

I would like to express my sincere appreciation to IRB Law LLP, led by Mr Dzul, together with Mr Aidil and the Syariah team, for their professionalism and dedication in preparing my will as well as my parents’ wills. Throughout the entire process, the team explained every requirement clearly and ensured that we fully understood the legal and Syariah implications before proceeding. Their patience, knowledge, and attention to detail gave us great confidence and peace of mind. On the day of the signing, Mr Aidil made the professional decision not to proceed with my father’s will due to concerns about his dementia. Rather than simply declining the signing, he carefully explained the reasons and advised us on the appropriate next steps. He also informed us that he would be prepared to meet with my father’s doctor should the doctor certify that my father has the mental capacity to understand and sign the will. I truly appreciate the team’s integrity, professionalism, and commitment to ensuring that everything is carried out properly and in accordance with both legal and Syariah requirements. I would not hesitate to recommend IRB Law LLP to anyone seeking reliable and trustworthy estate planning services.
