When do you need a Commissioner for Oaths?

Check the instructions from the court, agency or organisation receiving your document. Common requests include:

Statutory declarations

Declarations under the Oaths and Declarations Act 2000, including forms required by Singapore agencies, banks, employers and other institutions.

Use the recipient’s prescribed form where one is provided.

Affidavits

Statements sworn or affirmed for Singapore court or tribunal proceedings. Bring the final affidavit with all exhibits properly assembled.

Your lawyer or the relevant court guidance should explain the required format.

Probate and other court papers

Documents such as an Administration Oath and supporting affidavits may need commissioning. Other papers may require a different form of witnessing.

Check the signing requirements with your lawyer or the relevant court before attending.

Before your appointment

  1. Check the wording and format first. For court papers, check with your lawyer, the relevant court or the applicable court rules. Resolve any defects before attending.
  2. Print everything before your visit. Bring the completed, unsigned document with all exhibits assembled and any instructions from the recipient. It must be ready for signature at the appointment.
  3. Bring original identification. Your NRIC or passport should match the particulars in the document. Tell us beforehand about any difference.
  4. Arrange attendance. Each person making the declaration or affidavit must attend. Our standard service is an in-person appointment.
  5. Confirm language and access arrangements. Read our language limits below. Any interpretation or outcall attendance must be agreed before the appointment.

Sign only when asked

Our Commissioner checks your identity and administers the appropriate oath, affirmation or declaration before you sign.

You must understand the document and be satisfied that its contents are true. Commissioning does not verify the truth of your statements or provide advice on their legal effect.

If you have already signed, bring a fresh unsigned copy. Leave the signing date and the Commissioner’s section for completion as directed.

Mental capacity and willingness

The person making the document must have the mental capacity to understand its contents and the oath, affirmation or declaration, and must act voluntarily.

Tell us before booking if there are concerns about understanding or communication. If our Commissioner is not satisfied that the person understands or is acting freely, the commissioning cannot proceed. A family member cannot make the declaration on that person’s behalf.

Language support: please check first

Our standard commissioning service is for English-speaking deponents. You must understand the document and the declaration, oath or affirmation you are making.

By prior agreement, we may assist in Mandarin or Hokkien for simple documents of one or two A4 pages only. Our resources for interpretation are limited, particularly where technical legal terms need explaining.

Short interpretation may attract an additional fee estimated at S$50. Please confirm availability and the fee before attending.

We cannot offer interpretation for lengthy or complex documents or other languages or dialects. If your needs fall outside these limits, please arrange a commissioning service with suitable language support.

What the appointment covers

The appointment is for commissioning your prepared document. Our Commissioner does not provide legal advice, guidance on its contents or format, drafting, corrections or editing during the appointment.

If a document is incomplete, incorrectly formatted or otherwise not ready, we may be unable to commission it. You may need to correct and reprint it, then arrange another appointment.

We generally do not scan signed documents at our office. Please arrange your own scanning afterwards and bring any additional printed copies required by the recipient.

Commissioner, Notary or lawyer?

The wording of the document and the recipient’s requirements determine the service you need.

  • Oath, affirmation or statutory declaration for Singapore: usually a Commissioner for Oaths.
  • Notarisation for overseas use: a Notary Public. Notarisation involves a Notarial Certificate and SAL Apostille.
  • A certified copy or ordinary signature witness: the recipient may accept a lawyer. These are separate services.

No. The fee covers the commissioning act. Bring a completed document that you understand and are prepared to swear, affirm or declare is true. Obtain any drafting help or legal advice separately before attending. Our Commissioner does not advise on, draft, correct or edit your document during the commissioning appointment.

A Commissioner for Oaths cannot commission a document in a matter in which the Commissioner, or a member of the same firm, acts for a party or is otherwise interested. If our firm has prepared your document or acts in the matter, tell us so that the appropriate independent commissioning arrangements can be considered.

Please book and wait for confirmation before travelling. Appointments depend on our Commissioner’s availability. An online booking request does not mean that commissioning services are available outside office hours.

No. Commissioning records the oath, affirmation or declaration. Copy certification is a different service, and the receiving organisation decides what form of document or certification it accepts. Check its requirements before booking.
