Specific power of attorney in Singapore

A specific power of attorney lets someone you trust act for you in a defined transaction. Loh Eben Ong LLP prepares POAs for private property, motor vehicles and other agreed purposes in Singapore.

Tell us what needs to be done, who will act for you and where you will sign. We will review the scope and explain the next steps.

What can a specific power of attorney cover?

The donor gives the powers. The attorney, also called the donee, is the person appointed to use them. A specific POA defines what that person may do, for which matter and for how long.

Private property

Authorise defined acts for the sale, purchase, mortgage or management of a condominium, landed home or other private property in Singapore.

Provide the property details and any requirements from the bank or transaction lawyers.

Motor vehicles

Appoint someone to handle the vehicle matters set out in the POA. Identify the vehicle and explain the transaction or administrative task.

Send any wording or document requirements given by the receiving organisation.

Other defined matters

For banking, business or a customised appointment, send us the proposed powers and the recipient’s requirements for assessment.

A bank or other organisation may require its own form or approval. Acceptance should be checked before signing.

Choose powers that fit your purpose

A specific power of attorney is usually the starting point when you need help with one matter. An All Affairs or General POA gives wider authority and needs careful consideration.

Our All Affairs service is for one donor per POA, conversant in English, aged 75 or below and able to understand the document and give instructions freely. We generally do not prepare it for older or vulnerable persons.

Our online forms accept donors aged 21 to 75. If the donor is 76 or above, contact us for an individual assessment. These are our service conditions.

HDB, LPA or revocation?

HDB flat: use our HDB power of attorney service for the prescribed HDB formats.

Planning for loss of mental capacity: read about a Lasting Power of Attorney. An ordinary POA is not a substitute for an LPA.

Ending an existing appointment: see our POA revocation service. Do not assume a new POA automatically cancels an earlier one.

Tell us about any existing POA, capacity concern or pressure to sign before proceeding.

Your specific power of attorney, step by step

1. Scope and fee

Use the POA quotation form or contact us about a custom request. State the purpose, number of donors and signing location.

2. Instructions and draft

Send the particulars through our online POA form. We review your instructions, prepare the draft and ask you to check the details.

3. Sign your POA

Sign in Singapore or overseas following our instructions. The donor must understand the powers and sign freely with the required witnessing.

4. Deposit and use

We arrange High Court deposit where applicable and explain collection. Give the required documents to the bank, solicitor or other recipient before the attorney acts.

What to prepare

  • Names, identification and contact details of each donor and attorney.
  • The property, vehicle or transaction details and supporting documents.
  • The powers required, any limits, the intended duration and instructions for money due to you.
  • Your signing country, travel dates and transaction deadline.
  • Any existing POA or wording required by the receiving organisation.

If the donor needs interpretation in Mandarin or Hokkien for a property or vehicle POA, tell us at the outset. A surcharge applies. See the current fee conditions.

Signing in Singapore or overseas

For signing at our Middle Road office, book an appointment after submitting your instructions and confirming that the document is ready.

If you are overseas, tell us the country before arranging an appointment. We will advise on the witness, execution evidence and return of the signed original for your matter.

A Singapore Consular Officer or local Notary Public is commonly used for overseas signing. Requirements can depend on the document and its intended use. Follow our instructions before signing.

Specific power of attorney questions

A specific POA limits the appointment to the stated purpose or transaction. A General POA, sometimes called All Affairs, confers wider powers. Choose the scope you actually need and discuss any limits with us before signing.

No. An ordinary POA is generally used while the donor has mental capacity and ordinarily ends if that capacity is lost. An LPA allows appointed donees to make permitted decisions when the donor lacks capacity. The Office of the Public Guardian explains the LPA framework.

For a standard individual POA, the donor signs and the attorney generally need not attend. We still need the attorney’s correct particulars. Tell us if a recipient requires an acceptance, specimen signature or any additional document.

The deposit requirements depend on the document and its use. We will explain the position for your matter. The General Division of the High Court accepts POAs under section 48 of the Conveyancing and Law of Property Act, with the required evidence of execution. See the Singapore Courts guidance.

Its duration depends on the wording and the applicable law. It may be limited by a date or purpose. An ordinary POA also generally ends on revocation, death or loss of mental capacity. Special rules can apply to irrevocable powers or powers given as security.

No. The attorney can act only within the powers granted and the applicable rules. Some acts require personal attendance or cannot be delegated. A POA does not by itself give a non-lawyer a right to conduct court proceedings. Tell us exactly what the attorney needs to do.

Use our POA quote form for the current fees and service conditions. Costs can depend on the signing location, interpretation and any custom drafting. Confirm the quoted scope before proceeding and tell us about any urgent deadline.
