What does "Executor and Trustee" mean? An Executor is a person you appoint to carry out the instructions and distribute the assets in your Will after your death. You may choose someone you trust, such as a spouse, parent, sibling, cousin, or close friend. You must appoint at least one Executor. The person you leave your assets to can also act as your Executor. For instance, if you plan to give everything to your wife, you may appoint her as your Sole Executor unless you have a reason not to. The term "Executor" in this form refers to the capacity of both "Executor and Trustee."

Executor Section Explanation: You must nominate at least one Original Executor. If you appoint more than one, they will act together, unless one of them declines, is unable to act, or has passed away. The appointed Executor must be 21 years old at the time of Probate application. If they are under 21 at the time of your death, you may still appoint them as your Executor, as long as they are of age at the time of Probate application. They cannot be an undischarged bankrupt at the time of Probate. This section allows you to appoint up to three Original Executors. Wills Registry is a voluntary confidential registry maintained by Singapore Academy of Law (SAL) where a Testator (person making a Will) or his lawyer can deposit information on his Will. MIRROR WILL (IF REQUIRED)

A Mirror Will is specially created for couples who are married or in a close relationship with identical or similar wishes. It is a distinct and separate document from a Mutual Will and comes with its own cost. For instance, if the husband completes the form, the wife can opt to have a similar Will by selecting "Yes" and avoid filling out the form herself. We will then prepare separate Wills for both the husband and wife, using the information already provided by the husband. What is "commorientes"? If you and a beneficiary die at the same time, or in circumstances where it is uncertain who died first (for example, an accident), the law presumes that the elder died first. Your gift could then pass through the younger beneficiary's estate to their family, rather than to the people you intended. LASTING POWER OF ATTORNEY (LPA)

A Will takes effect upon death, and not upon losing mental capacity. If you lose your mental capacity without making an LPA, your family members will need to apply to the Court for appointment of deputies, which can be tedious and costly.

What you need before you start

Gathering a few details first makes the form much quicker. Please have the following ready:

Your particulars, including your NRIC or FIN, your address and your contact details.
Your executor, and a substitute executor if you want one.
Your beneficiaries and their shares. Together the shares must add up to 100% or to one whole.
Details of any specific gift, such as a property address, an account number or a serial number.
Whether your will should cover worldwide assets or Singapore assets only.

You may also upload your NRIC, your passport or an earlier will. However, every upload is optional.

What happens after you submit

First, our lawyers review your Singapore Wills Online submission. We may ask you for clarification, and we may decline an application without giving reasons. Then we prepare your draft will.

Next, book your appointment on our booking site. Choose Wills Signing once your draft is ready, and allow at least three working days after you submit. If you would rather speak to us before you submit, book the 15-minute Consult – Wills slot instead. Please use the same name for your booking and your submission, so that we can match the two.

Finally, you sign at our office. Two witnesses must be present at the same time, because the Wills Act 1838 sets out strict formalities. Our lawyers witness the signing, so the will is executed correctly.

Who can use Singapore Wills Online

You must be at least 21 years old and of sound mind. We prepare non-Muslim wills only, because Muslim estates in Singapore follow the Administration of Muslim Law Act 1966 and the rules of faraid. Muslim clients should therefore seek specialised advice.

We also take extra care with senior testators. For seniors we usually speak to the testator by phone or video call before we accept instructions, and we may ask for a doctor’s certification of testamentary capacity. As a result, our fees are usually higher, because taking instructions takes longer.

Options you can add in the form

Several sections of the form are optional. For example, you may add a mirror will for your spouse, so your partner receives a similar will without filling in the form again. You may also ask us to lodge your will record with the Wills Registry of the Singapore Academy of Law. Finally, you may add a Lasting Power of Attorney. A will takes effect when you die, while an LPA takes effect if you lose mental capacity.

Not by itself. Every submission is subject to our review, and we confirm your engagement separately.

Can I finish the form later?

Yes. Click “Save and Continue Later” beside the Submit button, then enter your email address. We send you a link, so you can return to your saved answers.

Do I have to visit your office to sign?

Yes. Singapore law requires two witnesses to be present when you sign, so signing takes place at our office.

What if I own property overseas?

You may choose worldwide coverage or Singapore assets only. If you already have a will abroad for those assets, then excluding them here usually avoids a conflict.
