If there is a will

We need to see the complete will and any codicils. Signing, witnessing or other discrepancies may require an affidavit of due execution or further evidence.

Overseas documents

Tell us where the death certificate was issued and where the deceased was domiciled. Translation and verification are separate requirements.

Estate value: CPF savings generally do not form part of the estate. If you select “CPF monies” in the form, explain what you mean in the message box; CPF investments and property bought using CPF may need separate consideration.

What affects probate fees?

  • The appropriate grant, the estate value and the work required.
  • The deceased’s domicile and any foreign grant or foreign-law evidence.
  • The will’s execution, language, condition and any discrepancies.
  • Minors, beneficiaries lacking mental capacity, and any administration bond or surety requirements.
  • Translation, verification and certification of overseas documents.

Our standard quotation covers the first four Letters of Authority to banks, insurers, share registrars or the Central Depository. Additional letters and work outside the quoted scope may incur further fees. Check the written quotation for the applicable terms.

Obtaining the grant is separate from collecting and distributing assets or dealing with estate property. Any additional work and fees should be agreed separately.

Documents we need to assess

Prepare the death certificate, the complete will and codicils (if any), applicants’ particulars, asset information and any foreign grant.

For an ICA digital death certificate, send the original downloaded PDF with its QR code and verification details intact. For an overseas certificate, provide the original-language document and any English translation. Please check with us before paying for translation or certification.

Types of probate applications in Singapore

These notes help you complete the form. Our lawyer will assess the appropriate application after reviewing the documents.

Usually, the executor named in a valid will applies. We review the will before confirming the application requirements. If the deceased was domiciled overseas, the relevant foreign-domicile rules must also be considered.

Letters of Administration usually applies where there is no valid will. If a valid will exists but no executor is able and willing to act, the application may instead be for Letters of Administration with the Will Annexed. The will continues to govern the estate; the absence of an executor does not by itself make the estate intestate. Mention the will in the form’s message box.

Tell us if any beneficiary is under 21 or lacks mental capacity. The number of administrators and the security required depend on the application. An administration bond and sureties may be required, subject to the applicable rules and any exemption or court order. We need these details to assess the work and fees.

An eligible foreign grant may be resealed to deal with Singapore assets. This can include qualifying Malaysian, other Commonwealth or Hong Kong grants. Eligibility depends on the issuing court or authority and the grant; it is not automatic. Send the foreign grant for review before assuming this route is available.

Part 6, rule 22 of the Family Justice (Probate and Other Matters) Rules 2024 provides routes for foreign-domiciled estates. Foreign-law evidence may be required, subject to the applicable route and exceptions. Domicile concerns a person’s permanent home in law; nationality, residence and place of death are not interchangeable. Read our foreign-domicile guide.

Where the deceased was domiciled overseas and the estate in Singapore consists wholly of immovable property, a limited grant under the applicable rules may be considered. It is not an option merely because the applicant wishes to deal with one property first. Tell us about all the Singapore assets.
