We designed the probate documents upload service around convenience and security. In practice, clients use it in two ways: Prior to engagement: You can submit your probate documents for our review. After online submission or engagement: After you have submitted probate online or engaged us for your probate matter, you may submit your documents to us for review.

Which Documents Should You Include in Your Probate Documents Upload?

The papers we need depend on whether the deceased left a will. Therefore, please upload whatever you already hold, and we will tell you what else the court requires. Death certificate. Upload the original Singapore death certificate, or the foreign certificate with a certified English translation. The will, if the deceased made one. Please also upload any codicil. Identity documents. These cover the deceased and every executor or administrator, for example the NRIC, FIN card or passport. Proof of relationship. For letters of administration, the court needs marriage, birth or adoption certificates. Asset papers.

Probate, Letters of Administration or Resealing?

Singapore recognises three main routes, and the probate documents upload form covers all of them. Grant of Probate The deceased left a valid will, so the executor named in the will applies. Letters of Administration The deceased left no will, so the next of kin apply according to the Intestate Succession Act. Resealing A Malaysian or other Commonwealth court has already issued a grant, and Singapore reseals it under the Probate and Administration Act 1934. Furthermore, where the deceased died domiciled outside Singapore, the court may require an affidavit of foreign law. Accordingly, tell us the domicile early, because that single fact shapes the whole application.

Is the probate documents upload secure?

Yes. The portal transmits your files over an encrypted connection, and we store them inside our matter management system. In addition, only the lawyers and staff working on your estate can open them. Therefore, you may upload sensitive papers such as bank statements with confidence.

Do I have to engage your firm before I upload?

No. You may upload documents so that we can review the estate and advise you first. Afterwards, if you decide to proceed, you simply submit our probate online engagement form. Meanwhile, an early review often prevents delays later.

What file types and sizes does the upload accept?

The form accepts common formats, including JPG, PNG, GIF, PDF, DOC and DOCX, and each file may reach 3 MB. Consequently, please scan long documents in parts, or compress them before you upload. If a file refuses to upload, simply contact us and we will suggest an alternative.

Which court handles probate in Singapore?

The Family Justice Courts handle probate and administration. In particular, the Family Courts deal with estates that do not exceed S$5 million in value, while larger estates go to the Family Division of the High Court. Because the value drives the forum, we prepare a careful schedule of assets from the papers you upload.

How long does a Singapore probate application take?

A straightforward grant of probate often takes about two to four months from filing, provided the papers are complete. However, letters of administration take longer, especially where beneficiaries live overseas or where a bond and sureties apply. Therefore, an early and complete probate documents upload usually shortens the whole process.

Does Singapore still charge estate duty?

No. Singapore abolished estate duty for deaths occurring on or after 15 February 2008. Nevertheless, the estate may still owe income tax, property tax or outstanding loans, so we ask for liability statements as well.

Do I need to translate a foreign death certificate?

Yes, where the document is not in English. The court expects a translation that a qualified translator has certified, and sometimes it declines a translation prepared informally overseas. Accordingly, upload the original and the translation together, and we will confirm whether the court will accept them.

1. Choose the right files

Gather the death certificate, any will and codicils, identity documents and relevant estate records. Use the checklist below for guidance.

2. Check each scan

Show the whole page, including signatures, seals and reverse sides. Keep each file within 3 MB and follow the limits beside each upload field.

3. Add your details

State the deceased’s name and your contact details. After all files finish uploading, review the form and submit it. Keep the confirmation for reference.

Uploading documents sends them to our firm for review. It does not file an application with the Court or, by itself, confirm that we have accepted instructions to act.

By uploading your documents here, you enable Loh Eben Ong to efficiently review them and prepare the necessary court papers. Please note that original or certified copies must be submitted to our office in due course. While we will diligently file your documents with the Court, it's important to understand that the Court reserves the right to reject any document based on applicable laws, rules, or practice directions. Loh Eben Ong cannot guarantee that documents submitted will be accepted by the Court. For example, the Court may:

1. Reject a Will on grounds of validity and request evidence of its proper execution
2. Decline a Death Certificate translated by a interpreter overseas
3. For foreign-domiciled deceased, require an Affidavit of Law concerning the validity of a Will or applicable succession laws

DEATH CERTIFICATE

For applications for Probate or Letters of Administration, the original death certificate is required, or a certified true copy thereof by the issuing authority of that certificate. Certified true copy of the death certificate by a foreign solicitor or notary public is not acceptable. If the death certificate is not in the English language, an official translation is required. Translation may be done in Singapore in accordance with the Rules of Court.

FOREIGN GRANT (RESEALING COMMONWEALTH)

For Foreign Grant, clients are required to provide either the Original Foreign Grant or a Certified True Copy issued by the Foreign Court. In the case of a Last Will, the original document or a Certified True Copy from the Foreign Court is mandatory. Where feasible, the Seal of the Foreign Court should be embossed. Please note that the Singapore Court will not accept Certified True Copies of either the Foreign Grant or the Will if they are authenticated by a foreign Solicitor or Notary Public.

Which probate documents should you upload?

The papers required depend on the will, the deceased’s domicile and the type of grant. This is a starting checklist; we may ask for further evidence after reviewing the documents.

Death certificate and identity

Provide the deceased’s death certificate and identity document, together with the proposed executors’ or administrators’ IDs. For a digital certificate, upload the original downloaded PDF where available.

Will and family records

If there is a will, include every page and any codicil. For an intestate estate, gather the relevant marriage, birth, adoption or other relationship records and details of the family members.

Assets and foreign grants

Send relevant bank, share, property and other asset records. Tell us about mortgages and overseas assets. For resealing, include the complete foreign grant, will if applicable, and issuing court’s certification.

Clear copies now. Keep the originals safe.

Scan in good light and check that the text is readable before uploading. Give files simple names, such as “Will – pages 1 to 4”. Avoid using identity numbers in filenames.

For digital records, send the original file rather than a screenshot. Keep any QR code, verification link and digital signature intact. Do not crop, mark or alter the document itself.

The form shows the accepted formats and number of files for each category. PDF is useful for a document with several pages. If a file exceeds 3 MB, reduce its size while keeping the text clear, or split it into numbered parts.

We will advise when to produce originals or acceptable certified copies. Please arrange with us before delivering an original will. An uploaded copy does not replace the original.

Wills and foreign documents need review

Where there is a will, we need to study it for validity concerns, discrepancies and execution issues. The Court may require an affidavit of due execution or other supporting evidence.

If a document contains non-English text, upload that document together with any existing translation. We will assess the translation and any further certification or evidence required.

Tell us where the deceased was domiciled at death. A foreign domicile or foreign-issued record may require additional evidence. Do not arrange certification or legalisation solely on an assumption that it will be accepted.

What happens after your upload?

We review the papers and identify any missing information. If you have not engaged us, we will first consider the request and confirm the proposed scope and fees.

Once we accept instructions, we can prepare the application documents and arrange the necessary signing. Court filing follows when the required papers and instructions are in order.

The Court decides whether the documents and application are acceptable. An upload does not guarantee a grant or a particular completion date.

Can I use the probate documents upload before engaging the firm?

Yes. You may send documents for an initial review or provide further papers for an existing matter. If you are already a client, include your matter reference and tell us what you are adding.

What if I do not have every document yet?

Upload the relevant papers you have and use the message field to explain what is missing. We can then identify the next documents needed. Do not select an unrelated upload category simply to add a file; contact us if you need help.

Will an uploaded will be enough for the application?

No. Keep the original will and any codicil safe. We need to review the complete documents and advise on producing the original. A missing original, alterations or execution concerns may require further evidence and a different approach.

What if my file will not upload?

Check the file type, the 3 MB limit and the maximum number shown beside that field. Wait for each upload to finish before submitting. If it still fails, contact us and describe the error so that we can advise on another way to provide the documents.

Can I upload a foreign grant or death certificate?

Yes, for review. Include the complete document and any existing translation. Resealing requires suitable evidence of the issuing court’s grant; a copy certified only by a foreign solicitor or notary may not meet that requirement. We will advise on your documents.
